JMFC To Pronounce Order On Archbishop’s Plea On 23rd August
Senior Counsel Saresh Lotlikar while arguing on behalf of the Archbishop submitted to the Court that the summons should be cancelled as Archbishop Filipe Neri Ferrao was the religious head of the Catholic Community in Goa and he appearing as a witness will only cause embarrassment.
Strongly opposing the Archbishop’s application for cancellation of summons, Adv. Aires Rodrigues submitted to the Court that the Archbishop was a very relevant witness and that the court had no powers to cancel the summons already issued to the Archbishop.
Adv. Rodrigues also submitted various judgments to the effect that the Judicial Magistrate First Class could not recall or review its own order.
Archbishop Ferrao is one of the ten witnesses Adv. Aires Rodrigues has sought to examine in his defence in the case in 15 villagers are being prosecuted for allegedly having trespassed into the corridor of the Ribandar Church on 16th August 2004 and disturbed a meeting of the Parish Pastoral Council.
