SC dismisses Appeal, Pacheco Faces Six Months Imprisonment
In a major setback to Goa’s flamboyant Rural Development Minister Francisco Xavier Pacheco alias Mickky Pacheco the Supreme Court of India today dismissed his appeal challenging the 17th July 2014 order of the Bombay High Court at Goa which had upheld his conviction in the 15th July 2006 assault on Electricity department Junior Engineer Kapil Natekar.
Justice A.R. Joshi of the Bombay High Court at Goa had set aside the order passed on 13th December 2013 by South Goa Additional Sessions Judge Vijaya Pol releasing Mickky Pacheco on probation. Justice A.R. Joshi had directed Mickky Pacheco to surrender before the Margao JMFC within two weeks and undergo six months imprisonment and pay a fine of Rs 1,500/-.
Against that order of the High Court Mickky Pacheco had preferred an appeal before the Supreme Court and was granted interim stay on 30
th July last year. Adv. Aires Rodrigues in a letter petition to the Chief Justice of India had expressed concern that Mickky Pacheco due to his close connection with the ruling party in Goa may try to derail the wheels of Justice in collusion with the Prosecution.
When Mickky Pacheco’s appeal came up for hearing today a bench of the Supreme Court comprising of Justice Fakkir Mohamed Ibrahim Kalifulla and Justice Shiva Kirti Singh dismissed his appeal while upholding the High Court order.
