Srinagar: Anti-corruption Bureau (ACB) seized records in connection with case FIR No. 04/2020 under the Prevention of Corruption Act against an Ex. BMO for granting sanitation contract to his nephew.
Anti Corruption Bureau registered an FIR against Dr. Syed Masood Ahmad, Medical Superintendent, District Hospital Baramulla for conferring an undue monetary benefit to his close relative as Block Medical Officer Sopore during the years 2013 to 2017.
A verification conducted by Anti Corruption Bureau revealed that Dr. Syed Masood Ahmad, then Block Medical Officer Sopore has granted an annual contract for sanitation of Sub District Hospital Sopore to the firm of his nephew M/s Sigma Solutions, Tangmarg Baramulla vide order No. Est/SDH/Spr/ 1390 dated 12.09.2013 on its quoted rate of Rs 1.90 per sq through a manipulated tendering process. This contract was subsequently extended to M/s Sigma Solutions, Tangmarg Baramulla illegally for a further two years in one go 2014-15 & 2015-16 by Dr. Syed Masood Ahmad then BMO Sopore vide order No. Estt/SDH/ Spr/14-16 dated 03.04.2014 in league with an in-house Board of the Hospital comprising of Dr. Abdul Hamid Khan (Physician), Dr. Fida Hussain Kanjwal (Assistant Surgeon), and Dr. Arshad Hussain Khuroo (Dental Surgeon). The contract was further extended in favour of M/s Sigma solutions Tangmarg Baramulla for the year 2016-17 by the next incumbent BMO Sopore namely Dr. Sami Ahmad Zargar vide order No. Estt/SDH/ Spr/4424 dated 31.03.2016 and order No. Estt/SDH/ Spr/1853 dated 03.10.2016.
Verification brought to the fore that Tender Notice No. Est/SDH/Spr/ 1137-41 dated 19.08.2013 was issued by Dr. Syed Masood Ahmad, then BMO Sopore for the outsourcing of Sanitation and House Keeping of Sub District Hospital Sopore on an annual rate contract basis for the year 2013-14, which was published only in lesser circulated newspaper departmentally. In response, bids of four firms;
(i) M/s Global Scientific Enterprises Srinagar,
(ii) M/s Suhail & Company Srinagar,
(iii) M/s Sigma Solutions Tangmarg, and
(iv) M/s Al-Rashid Enterprises Baramulla
were shown to have been received. The bids of two firms M/s Suhail & Company Srinagar and M/s Al-Rashid Enterprises Baramulla were rejected at the outset for not enclosing requisite CDRs of Rs 30,000/- each. The proprietors of the remaining two firms M/s Global Scientific Enterprises Srinagar namely Syed Badrul Duja and M/s Sigma Solutions, Tangmarg namely Syed Muzamil Hussain were nephews of Dr. Syed Masood Ahmad, then BMO Sopore whereas. The two rejected bids were found fictitious and managed by Dr. Syed Masood Ahmad to manipulate the tendering process. It was found that the bids of two firms of his nephews were also without requisite CDRs on the date of opening of bids and liable for rejection at that time. But, their CDRs were managed after the opening of bids by accused Dr. Syed Masood Ahmad.
The verification further revealed that a fresh Tender Notice was issued and published by concerned Block Medical Officer Sopore during the year 2017-18 and in response, nine (09) bids were received and the contract was again allotted to M/s Sigma Solutions Tangmarg Baramulla at his quoted rate of Rs 0.60 per sqft only vide order No. 180 dated 17.04.2017 of Block Medical Officer, Sopore. The verification thus, established that the contract granted to the firm M/s Sigma Solutions Tangmarg Baramulla of Syed Muzamil Hussain @ Rs 1.90 per sqft in the year 2013-14 by his uncle Dr. Syed Masood Ahmad, then BMO Sopore through a manipulated tendering process was hugely exorbitant, as he has himself quoted the rate of Rs 0.60 per sqft only after four years in a fair tendering process for the year 2017-18. An exorbitance of Rs Rs 26,66,938/- has been worked out in the total payment of Rs 38,97,832/- made to the firm from Hospital Development Fund in the four years of its work contract.
Verification further revealed that neither Service Tax nor Income Tax nor Cess from has been deducted from the bills of Contractor Syed Muzamil Hussain subjecting the State Exchequer to an additional loss of Rs 5,42,262/- with corresponding undue pecuniary advantage to the firm M/s Sigma Solutions Tangmarg Baramulla.
By acting in this manner, Dr, Syed Masood Ahmad has, in league with the above-mentioned officers/officials of Health Department, conferred undue pecuniary advantage upon his nephew Syed Muzamil Hussain, Proprietor of M/s Sigma Solutions Tangmarg Baramulla, and thereby misappropriated an amount of Rs 32,09,200/- from Hospital Development Fund (HDF). Consequently, case FIR No. 04/2020 u/s 5(1)(c), 5(1)(d) r/w 5(2) J&K P. C. Act Svt 2006 and section 120-B RPC has been registered against them in Police Station, Anti Corruption Bureau Baramulla and the investigation taken up.
During the investigation, the house of Contractor Syed Muzamil Hussain was raided by ACB on 01.09.2020 and during the search, several incriminating documents were recovered by ACB.
Today on 03.09.2020, ACB raided Block Medical Office Sopore and seized various documents of this murky deal. Sources told that searches & raids in various locations will continue.
Sources in the Directorate of Health Services Kashmir confirmed the development and said that ACB has informed the Directorate about the registration of the Case against Ex. BMO Sopore & others and simultaneously Departmental action are also being contemplated.
