Civil Judge Senior Division Kshama Joshi on Thursday adjourned the defamation case filed by Advocate General Subodh Kantak against Advocate Aires Rodrigues for 16th June.
When the matter came up for hearing, Adv. Rodrigues urged the presiding judge to recuse herself from the case as her husband M S Joshi, a practicing advocate in Panjim Courts was a close friend of Subodh Kantak.
When the judge asked that the request be submitted to the court in writing, Adv. Rodrigues submitted that he would expect the judge to suo motto recuse herself from hearing the case in keeping with the principle of fair play and justice.
It may be recalled that Kantak had filed two defamation suits against Adv. Rodrigues after the latter alleged that Kantak was the highest paid Advocate General in the country.
While one case was dismissed by the Judicial Magistrate First Class on account of Kantak’s failure to appear before it, in the other case Kantak has sought Rs. 15 crore by way of damages and vowed to utilize the money for charitable causes like old age homes, orphanages and animal welfare.
