Balvinder Singh transferred to Chennai Bench

Technical member of the principal Bench of National Company Law Appellate Tribunal (NCLAT) at Delhi has been transferred to Chennai so that the Chennai Bench of NCLAT can start functioning.

The notification passed under the orders of NCLAT Acting Chairperson states that Balvinder Singh, Member (Technical) is transferred to the Chennai Bench so that he holds court with judicial member, Justice Venugopal M.

The notification further states that only new cases would be filed and entertained at the Chennai Bench and that all pending cases would continue before the NCLAT principal Bench.

On March 13, 2020, the Central government had notified the constitution of the NCLAT Chennai Bench. As per the notification, the NCLAT Chennai will be hearing appeals from the NCLTs having jurisdiction over Karnataka, Tamil Nadu, Kerala, Andhra Pradesh, Telangana, Lakshadweep, and Puducherry.

However, the Bench was non-functional for a long time leading to an increased clamour to make it operational especially in the wake of lawyers and litigants facing difficulty in travelling to New Delhi in view of COVID-19 pandemic.

In December 2020, a petition was filed in the Supreme Court seeking a direction to make functional the Chennai Bench of the National Company Law Appellate Tribunal (NCLAT).
