Kasaragod: Central Bureau of Investigation (CBI) issued a notice to the Kerala Crime Branch (CB) demanding immediate handing over of all files related to the Periya double Murder case.
The CBI had taken over the case following a direction from the Division Bench of Kerala High Court last month.
However, the Crime Branch of the state police has been shying away from transferring the files concerned despite repeated reminders.
The state police has been delaying the process waiting for the Order of Apex court, on an appeal filed by the government against the High Court Order.
The Supreme Court, in last week, had not stayed the Order of the High Court
Sources citing CBI sources said, the notice has been issued under Sec. 93 of the CrPC, which is considered a rare occurrence on the part of the Premier Investigating agency of the country.
The section enables the CBI the power to take over the case files in the event of refusal by the Crime Branch, sources pointed out.
The prosecution case, which the local police and later the Crime Branch wing of Kerala had investigated was that a group of people, in connivance with local Marxist leaders, hacked to death the two Youth Congress workers, Kripesh and Sarath Lal in Periya of Kasaragod district on February 17, 2019.
Now the Crime Branch will have no option but to transfer the case files to CBI who will further investigate the case, by retaining the charge sheet filed by the crime branch, as directed by the High Court.
