CIC Appointment case now going to SC, HC rejects petition

The challenge to Goa government’s selection and appointment of Leena Mehendale as the Chief Information Commissioner (CIC) is now set to move to the Supreme Court.

Adv. Aires Rodrigues has today stated that in public interest he will move the Supreme Court after a Division bench of the Bombay High Court at Goa comprising of Justice N.H.Patil and Justice F.M.Reis today rejected his petition.

Adv. Rodrigues has contended that the entire selection process and appointment of Leena Mehendale as CIC of Goa was illegal and not in accordance with law as she did not possess the eminence in public life required for the post of Chief Information Commissioner.

Alleging that Leena Mehendale’s selection and appointment was all stage managed, Adv. Rodrigues has stated that Leena Mehendale was also closely connected with the very controversial Ramnathi based Sanatan Sanstha.

Adv. Rodrigues has also stated that Leena Mehendale could not have been considered for the post of CIC bypassing Goan candidates, in view of the Goa Official language Act which mandates knowledge of Konkani which she did not have.

Adv. Rodrigues has further stated that in the selection of Leena Mehendale the selection committee had breached its obligation as stipulated by the Supreme Court in failing to indicate details of her alleged eminence in public life and her alleged knowledge and experience in the particular field, whilst recommending her name to the Governor for appointment as Chief Information Commissioner.  

Adv. Rodrigues has alleged that the selection and appointment of Leena Mehendale to the post of CIC was arbitrary, contrary to all norms, rules and directions of the Supreme Court as the selection discloses non application of mind and was entirely uninformed, made without any rational basis and lacking in transparency.
