GoaChronicle.com LEAKS: How does a 15 year old from Karnataka get a Goa Voter Card of Margao?

GoaChronicle.com in its expose brings to you a shocking report of how a 15 year old from Karnataka now showing residence at Moti Dongor, Margao with dubious documents gets clearance from government authorities for a voter identity card from Goa. In a Form 8 – Application for correction to particulars entered in Electoral Rolls in possession of GoaChronicle.com, a lady by the name of Mumtaz Bawar residing at 71 Monte Hill, Margao, Salcette -Goa has written to the Electoral Registration Officer asking for a change in her name on the electoral rolls.

Here are the details Mumtaz Bawar has filled:

Serial number in that part       : 60
Husband Name                      : Lalsab Bawar
Date of Birth                       : 02/06/1991
Name of Constituency             : 31, Margao

Interestingly the form does have the signature or the thumb impression of the applicant neither does it have a date in which the applicant applied for the change in name on the electoral rolls.

But it does contain the noting and signature of the Booth Level Officer (BLO) whose names is not mentioned by GoaChronicle.com investigation revealed that the name of the officer is Shivram Jammuni who also hold a position of Accounts Clerk, in Joint Director Accounts Department, South Goa which states, “The applicants surname may please be corrected as per religious marriage certificate.”

In another form of the ‘Election Commission of India’ – Form for submission of photograph (optional) along with Form 6/8/8A – the lady Mumtaz Bawar does not put her photograph (but that is optional) but yet again interestingly she never signs or puts a thumb impression.

However this is not the shocking part of our investigations, it is only the beginning.

In her application to the Electoral Registration Officer, Mumtaz Bawar has attached documents of her previous Election Commission of India Identity Card, marriage certificate and school transfer and leaving certificate.

In the Election Commission of India Identity Card:
The Elector’s Name is        : Mumtaj Nadaf
Husband Name                 : Lalasab Nadaf
Sex                                 : Female
Age as on 01/01/2006 : 20

The other details which follows is the residential address and this card is been signed by the Electoral Registration Officer for Margao Constituency and bears the stamp of the office.

The most shocking part of the Election Commission of India (ECI) Identity Card is the Age as on 01/01/2006 which shows the lady Mumtaj Nadaf as 20 years old. But if we go by her application in the Form 8 wherein it shows that her Date of Birth is 02/06/1991 then as on 01/01/2006 she would be only fifteen years of age and not 20 years as mentioned in the ECI Identity Card.

As per Section 19 of the People Representation Act of 1950 it is a clear violation and a fraud. The section states the following;

Conditions of registration.–Subject to the foregoing provisions of this Part, every person who —
(a) Is not less than eighteen years of age on the qualifying date, and
(b) is ordinarily resident in a constituency,

Shall be entitled to be registered in the electoral roll for that constituency

Even in her marriage certificate Notarised by the Notary S. Yusuf S. Abdulla from Margao overlooks this fact of her age in the marriage certificate true copy (in possession of GoaChronicle.com)

The details of the marriage certificate are as follows;

The wedding has taken place at the Anjuman – E – Quazzat, Gulbarga, Karnataka
The Date of Nikha is 20/12/2004
Bridegroom Name   : Lalsab Bawar
Bride Name            : Mumtaz Bi
Bride Age               : 18 years

Yet again in 2004, how can Mumtaz Bawar alias Mumtaz Nadaf alias Mumtaz Bi be 18 years of age, when as per her own acknowledgement of the Date of Birth on Form 8 in the application sent to the Electoral Registration Office her Date of Birth is 02/06/1991, which means she was married when she was married when she was thirteen years of age.

It gets even more shocking in the true copy of wedding certificate which is notarised her husband name shows as Lalsab Bawar, this happened on 20/12/2004 but in the Election Commission of India Identity Card issued on 02/08/2006 her husband name is Lalsab Nadaf.

Who are Lalsab Bawar and Lalsab Nadaf?

In this form though Lalsab Bawar signs the document; and there is not which appears to be from the BLO since the writing is identical but is not signed by the BLO which states, the applicant surname may please be corrected as per B/C (referring to Birth Certificates)

To the form are attached documents of the former Election Commission of India Identity Card and the Birth Certificate issued by Directorate of Planning, Statistics and Evaluation – Margao Municipal Council.

Even in the Election Commission of India – Form for submission of photograph (optional) along with Form 6/8/8A, it carries a photograph and signed by the applicant Lalsab.

In his Election Commission of India Identity Card

The Elector’s Name is        : Lalsab Nadaf
Husband Name                  : Bashasab Nadaf
Sex                                  : Male
Age as on 01/01/2006        : 22

In the Birth Certificate Copy issued by Directorate of Planning, Statistics and Evaluation – Margao Municipal Council issued on 21/03/2011 you have all the details of Lalsab Bawar and his family.

Now to further ensure that Lalsab Nadaf gets his birth certificate details changed to Lalsab Bawar, GoaChronicle.com investigation revealed that Lalsab Nadaf has approached the court for a Negative Declaration claiming that his date of birth details need to changed and has been wrongly entered. Judicial Magistrate First Class Kalpana Gawas in the case 415/2010/II issued an order on 28/06/2010 for the change in name in the birth certificate.

While Lalsab Nadaf and Lalsab Bawar seems to have taken the legal recourse to ensure change in the date of birth details, The question however which is pertinent is on what basis did the Electoral Registration Officer for Margao constituency issued Lalsab Nadaf now Lalsab Bawar (as claimed) the Election Commission of India Identity Card in the first place without checking the birth certificate details and why did Lalsab Nadaf enter wrong details before. And the questions become most pertinent based on the false details of the wife and also IN the granting of ECI identity card in 2006.

But most importantly and incriminating is in the marriage certificate of Mumtaz Bi alias Mumtaj Nadaf alias Mumtaz Bawar the husband name is Lalsab Bawar in 2004. So in 2006 how did the Electoral Registration Officer of Margao Constituency issue Mumtaj Nadaf (now Bawar) an ECI Identity Card and issue the same to Lalsab Nadaf.

The question GoaChronicle.com is asking is that in 2006 a lady from Karnataka is issues of ECI Identity Card making her eligible to vote and probably has voted, but how could it be legally permissible when she is below the age to vote. And did the chief minister who is known to be the biggest benefactor of votes from Moti Dongor got elected on the basis of this fraud and how many such cases such as this exists.
