The Bombay High Court at Goa, on Friday acquitted two policemen who were sentenced to life imprisonment by the District Court in the matter of Dattu alias Murgesh Anant Naik Dessai’s custodial death matter.
The trial court had convicted Shripati Desai from Kolhapur and Madhu Dessai from Salcete in the case while acquitting the other accused in the matter holding them guilty of wrongful confinement and murder.
It may be recalled that 30 year old Dattu who was also handicapped, was picked up by the police on 27th June 2001 from Quittol village and he was found hanging from a cashew tree behind the Cuncolim police station the next day.
The police had no records to show either his arrest or release and though they claimed that he was released on 27th June itself, a judicial enquiry held that Dattu died while in police custody and accordingly a charge sheet was filed against four police personnel.
While the trial court acquitted had acquitted Jitendra Fal Dessai and Narendra Fal Dessai in the matter, Shripati and Madhu were sentenced to life imprisonment.
Following the High Court’s order on Friday, the two were released from Aguada jail where they were housed.
