HC Questions Panchayat’s Bonafides

The Bombay High Court at Goa on Monday directed the coastal panchayats to file affidavits disclosing the documents relied upon by them while withdrawing the notices of demolition served upon violators of the Coastal Regulation Zone notification.
When the matter came up before the court on Monday, the coastal panchayats informed the court that around 700 structures that were in violation of the CRZ notification were demolished while notices issued to 321 others were withdrawn as they were found to be in existence prior to 1991 when the CRZ notification came into effect.
However, the Court has asked the panchayats to file an affidavit within four weeks disclosing the documents that established that the structures were existing prior to 1991,
The Court also suggested appointing a commissioner to check the bonafides of the documents relied upon by the panchayats to withdraw the notices and also to check whether all the violations have been demolished.
