The Division bench of the Bombay High Court at Goa comprising of Justice S B Bobde and Justice F M Reis on Monday directed the Advocate for Raj Bhavan to instruct the Public Information Officer of his client not to deny information to applicants on grounds that a matter was pending in the court.
The direction came after Advocate Aires Rodrigues pointed out to the court that the Raj Bhavan was currently denying information to all applicants with a standard reply that the matter is pending before the High Court.
The Court while directing that the petition filed by the Goa Governor challenging the Information Commissioner’s order holding the Governor to be a public authority and directing him to provide the information sought under Right to Information Act to be heard and disposed on 15th June also added the petition filed by Manohar Parrikar in 2008 against the Governor be also heard on the same day.
The petition came about after the Governor refused to provide information to Adv. Rodrigues regarding his complaint against Advocate General Subodh Kantak on grounds that the Governor was not a public authority.
Adv. Rodrigues challenged the Governor’s stand before the Information Commissioner who upheld his contention following which the Governor approached the High Court where he is represented by a private advocate and not the Advocate General.
