Its ‘Mine’, To Violate!

Perusing information provided by the Forest Department and the Department of Mines & Geology of the Goa government, it is evident that 23 of the 74 mining leases in operation in Goa do not have the mandatory licenses or permission under different Central Acts or rules and regulations. Probably because the highest number of leases is in operation in Sanguem taluka, the highest number of violations is found there. Of the 51 leases operating in Sanguem taluka; as many as 15 are without the permissions. In Sattari taluka 6 of the 15 leases and in Quepem two of the eight are operating without the required permissions.
That there are new entrants in this field who want to make hay while the sun shines is evident in the fact that Nationalist Congress Party office bearer Prafula Hede, who incidentally, is in charge of Goa, is operating a mining lease in Collem village of Sanguem taluka that began operations only during the current financial year.
Surprisingly, Hede is operating the mine without the required permission from the Chief Wildlife, Local Warden’s permission. How Hede got the mine is not yet clear but the fact is that his party legislator Jose Philip D’Souza is the Revenue Minister in Goa.

Amongst the mining firms, three are operating two mines each without the necessary permissions. M/s Damodar Mangalji & Co. Ltd is operating two mines in Pissurlem village of Sattari taluka without permissions. While the lease over Survey No. 7/71 is being operated without the Chief Wildlife Local Warden’s permission, the one in Survey No. 95/52 is being operated without the mandatory permission under the Wildlife Protection Act.
M/s Sesa Goa Ltd., is operating two mines without the required permissions. While the lease over Survey No. 69/51 of village Codli in Sanguem taluka is being operated without the mandatory permissions under the Wildlife Protection Act, the one in survey No. 6/55 in Honda village of Sattari is being operated without the permission from National Board of Wildlife besides being over mined.

M/s Sesa Goa has been permitted to extract 0.5 MTPA per annum from this mine. However, in 2008-09 it extracted 0.74 MTPA, in 2009-10 it extracted 0.66 MTPA and in 2010-11 till the month of January had extracted 0.51 MTPA.

M/s Chowgule & Co. Ltd., is operating two mines in Sattari taluka without permissions. While the lease on survey No. 41/56 of village Pissurlem is being operated without permission under the Forest Conservation Act, the one on Survey No. 31/55 of Gavanem village is being operated without permission from the Chief Wildlife Local Warden.

In Quepem taluka in Survey No. 7/78 of village Molcornem, Gajanan Podiyar is extracting manganese ore without having Environment Clearance from the Ministry of Environment and Forests. On the other hand Pravin Kumar Gosalia is extracting bauxite from the villages of Quitol, Naquerim, Morpila and Fatorpa in Quepem taluka and Velim in Salcete taluka without clearance from the Forest Department even though the land comes under Forest area.

In Sattari taluka, the other mine operating without permissions is M/s R S Shetye & Bros’ in Survey No. 70/51 of Pissurlem village which is operating without permission from Chief Wildlife Local Warden.

In Sanguem taluka following are the other mines operating without requisite permissions:

M/s Emco Goa Pvt. Ltd., in Survey No. 7/41 of village Sigao without the Chief Wildlife Local Warden’s permission;

M/s Sociedade Timblo Irmaos Limitada in Survey No. 87/53 of village Sigao without the Chief Wildlife Local Warden’s permission. Besides this site is over mined. While the company has been permitted to extract 0.4 MTPA per annum, in 2008-09 the company extracted in excess of the permitted amount;

V M Salgaoncar & Bro. Pvt. Ltd. In Survey No. 50/53 of Sigao village without Chief Wildlife Local Warden’s permission;

In Survey No. 7/58 of village Collem where the mine is being operated in the name of late Cipriano D’Souza without permission from the Chief Wildlife Local Warden;

In Survey No. 50/58 of village Collem where the mine is being operated in the name of late Mohanlal Rege without permission from Chief Wildlife Local Warden and also under the Forest Conservation Act;

In Survey No. 17/49 of village Rivona a mine is being operated in the name of late Atmaram Palondicar without permission from the Chief Wildlife Local Warden;

X A X A Aziz S A Gofur in Survey No. 53/51 of Village Curpem without permission from the Chief Wildlife Local Warden and under the Forest Conservation Act;

N S Narvekar in Survey No. 40/51 of village Santona/Kirlapal without permission from the Chief Wildlife Local Warden;

M/s Sova (Balkrishna Aude) in Survey No. 45/54 of Village Sangod without permission from the Chief Wildlife Local Warden;

In Survey No. 41/54 of Village Cormonem where a mine is being operated in the name of late Mrs. Ahiliabai Sardessai without permission from the Chief Wildlife Local Warden;

M/s Marzook & Cadar Ltd., in Survey No. 4/55 of Village Dharbandora without permission under the Wildlife Protection Act;

Mr. Mahabaleshwar Garco in Survey No. 2/57 of Village Muguli/Costi without license under the Wildlife Protection Act.

Besides the over mining mentioned above, other mines that have extracted ore beyond the permitted limits are:

M/s V S Dempo & Co. Pvt. Ltd., that extracted 1.26 Millon tons per annum (MTPA) s as against the permitted limit on 1.1 MTPA in 2008-09 from its lease over Survey No. 20/54 in Village Onvaliem of Satari taluka;

M/s V S Dempo & Co. Pvt. Ltd., which extracted 1.4 MPTA as against the permitted limit of 1.1 MTPA in 2009-10 from Survey No. 5/54 of village Onvaliem in Satari taluka;

V G Quenim extracted 0.6 MTPA in 2008-09 and 0.7 MTPA in 2009-10 from the mine in Survey No. 16/55 of village Sonus in Satari taluka as against their permitted limit of 0.437 MTPA;

M/s Sociedade Timblo Irmaos Limitada extracted 0.57 MPTA till January during the last financial year from its mine in Survey No. 88/52 of Village Sigao in Sanguem taluka as against its permitted limit of 0.55 MPTA;

V M Salgaonkar extracted MTPA from the mine in Survey No. 13/55 of Village Sigao in Sanguem taluka in 2009-10 even though its permitted limit was 0.72 metric MTPA, but actually extracted 0.88 MTPA.

M/s V S Dempo & Co. Pvt. Ltd. upto January of last financial year has extracted 0.13 MTPA from its mine at Survey No. 35/52 in Colomb village of Sanguem taluka while its permitted limit in 0.10 metric MTPA;

M/s Chowgule & Co. Ltd., extracted 0.61 MTPA in the year 2009-10 from its mine under Survey No. 22/50 of Village Costi in Sanguem taluka even though its permitted limit was 0.42 metric MTPA;

In the year 2009-10, M/s Mineira National Ltd., extracted 1.16 MTPA from its mine at Survey No. 62/51 in Village Santona/Kirlapal even though it was permitted to extract only 0.70 MTPA;

M/s Sociedade Timblo Irmaos Ltd, up to the month of January of the last financial year, extracted 0.6 MTPA of ore as against its permitted capacity of 0.54 MTPA.

While these violations could be detected by comparing data, violations of the conditions of the Environment Clearance have not been noted nor quantified.
