JMFC directs Goa Police to register F.I.R against Tourism Minister

The Mapusa Judicial Magistrate First Class (JMFC) Reina Fernandes today directed the Porvorim Police to register an F.I.R of cheating against Goa’s Tourism Minister Dilip Parulekar in connection with the 599 sq mts of prime land on the Chogm road at Porvorim alleged to have been fraudulently and illegally grabbed by Dilip Parulekar.

Allowing the complaint filed by Adv. Aires Rodrigues,  the JMFC has directed the police to register the F.I.R under Section 119,120, and Section 420 read with 120 B of Indian Penal Code. The JMFC has also directed that the F.I.R be registered against Peter Martins the attorney of Communidade of Serula along with Irene Sequeira, the then Administrator of Communidade of Bardez.

Ruling that the complaint filed by Adv. Aires Rodrigues discloses the ingredients of the offences, the JMFC has directed the Porvorim Police to investigate the case after registering the F.I.R. 

In his petition filed under Section 156(3) of the Criminal Procedure Code had drawn the JMFC’s attention that despite a criminal complaint having been filed on 8th November the Porvorim Police in rank violation of law was shielding Tourism Minister Dilip Parulekar by not registering the F.I.R.  

Adv. Rodrigues had in his petition submitted that Dilip Parulekar, Peter Martins and Irene Sequeira by their acts of omission and commission and by acting in criminal conspiracy had caused immense loss to the Communidade of Serula by defrauding its prime land at a throw away price to the detriment of the Communidade.

Pointing out that the land given away to Dilip Parulekar was without any auction and without following the procedure contemplated under the Code of Communidade, Adv. Rodrigues alleged that the whole intention was to fraudulently facilitate the doling out of prime Communidade land to Dilip Parulekar.  

Adv. Rodrigues also pointed out that the Communidade of Serula  granted the land admeasuring 599 sq. mts in Survey No. 376/6 of Socorro Village to Dilip Parulekar on receipt of a mere Rs. 3,41,320/- though the value of the land was otherwise worth more than a crore.

Adv. Rodrigues had submitted to the JMFC that as Dilip Parulekar in connivance with Peter Martins and Irene Sequeira had obtained this prime Communidade land at a throw away price by illegal means they had committed offences punishable under Section 119, 120, 420 read with  120-B of IPC.
