Nationalist Congress Party legislator Micky Pacheco on Wednesday appealed against the Judicial Magistrate First Class’ order convicting him of assaulting an Electricity Department Junior Engineer and sentencing him to one year’s imprisonment.
Speaking to media persons outside the District and Sessions Court at Margao after filing the appeal, Micky reiterated that he had confidence in the judicial process and that he would be acquitted of the charges.
The grounds for appeal are primarily questioning whether the concerned Junior Engineer was on official duty as it is argued that since it was a holiday on that particular day, there was no question of the Junior Engineer being on duty.
Besides another ground was that there was no evidence of the Junior Engineer travelling to Micky’s residence at Betalbatim from his office.
While stating that Micky has been convicted on mere suspicion, the appeal states that the magistrate exceeded his jurisdiction while passing the order and wrongly and illegally convicted Micky.
Another ground for the appeal is that the complainant’s testimony in court was totally different from the original complaint.
Micky disclosed that he had also sought a stay on the JMFC’s order pending the final disposal of the appeal.
