NRI Woman Moves High Court Seeking Children Custody

A Goan NRI based in Qatar Precyla Baretto Fernandes has today moved the Bombay High Court at Goa seeking custody of her three minor boys aged 4, 8 and 9 who were abducted in Qatar and brought to Goa by her former husband Collin Louis Fernandes who hails from Mapusa.

Through a habeas Corpus petition Fernandes represented by Adv. Aires Rodrigues has sought directions by the High Court to the Mapusa Police and her former husband’s brother Austin Fernandes to produce her kids in Court and be given back to her. A Division bench of the High Court comprising of Justice A.P Lavande and Justice U.V.Bakre will hear the petition on July 31st.

Having been married in Qatar Precyla Fernandes was on 30th January this year granted divorce from her husband Collin Louis Fernandes by the Qatar Court. The Court also gave Fernandes the legal custody of her three children.

Last month on 12th June Collin Fernandes abducted the three kids from his former wife’s residence in Qatar and flew them to Goa. He left back for Qatar after leaving the three boys at Duler in Mapusa with his brother Austin Fernandes who works as a Front Office Manager at Ronil’s resort in Baga. The three boys were later given admission at Blooming dale primary school at Duler in Mapusa without a leaving certificate from the Qatar school where they were studying.

After the abduction the Indian Embassy in Qatar wrote to the Chief Secretary of Goa giving details of the abduction of the three boys and seeking immediate action by the authorities in Goa. Fernandes on 20th July also filed a written complaint with the Mapusa police. With the authorities having failed to act and rescue her three children she has now moved the Bombay High Court at Goa to get back their custody.
