The Goa State Chief Information Commissioner Mr. Motilal Kenny on Wednesday morning declined to stay the roceedings of the complaint filed by Adv. Aires Rodrigues against the Goa Governor Dr. S.S.Sidhu for not complying with the Right to Information Act.
When the matter came up before the Commissioner, Advocates representing the Governor sought a stay on the proceedings. However, the Commissioner refused their plea and advised them to move the High Court if they so desired.
The Commissioner has now fixed the matter for 25th March after making it very clear that he will not grant any more adjournments. The Commissioner is hearing the petition which will determine whether the Governor is a public authority or not under the RTI Act.
The petitioner Adv. Aires Rodrigues strongly objected to the Governor’s Advocates’ application and argued that the violation of RTI Act by the head of the State was not only a bad precedent, but also an obstruction to the implementation of the act in its letter and spirit.
The petition before the commissioner is a result of the stand taken by the Governor that he is not a public authority under the RTI after Aires Rodrigues sought to know from him what action was taken with regards to his complaint against Advocate General of Goa Subodh Kantak.
