Satari Resident takes Govt to Court on Termination of Service

A Division Bench of the Bombay High Court at Goa comprising of Justice A.P.Lavande and Justice U.V.Bakre today issued notice to the Goa Government on a petition filed by a resident of Poriem in Satari Sanjay Rane challenging the termination of his services as Field worker in the Agriculture department. The Court today gave the Goa government two weeks time to file their reply.

Sanjay Rane has in his petition challenged his termination order dated 6th July 2012 as no reasons have been given in the termination order and neither has a departmental inquiry been conducted against him. He has submitted that the termination was arbitrary, contrary to law and that it violates his fundamental rights under Articles 14, 16 and 311 of the Constitution of India.

On the recommendation of the Departmental Selection Committee Sanjay Rane by an order dated 22nd June 2009 was appointed as a field worker. Rane’s name also figures in the list of seniority of field workers in the Directorate of Agriculture dated 23rd June 2010.

Sanjay Rane has in his petition alleged that his services were terminated by the Goa Government at the instance and instigation of a local BJP leader and now Sarpanch Jivbarao Tangabarao Rane with whom he has had a property dispute for many years. Sanjay Rane has further submitted that on account of this property dispute, Jivbarao Rane has been harassing him with false and baseless complaints.

Sanjay Rane has sought directions of the High Court to the Goa Government to revoke his termination and reinstate him in service with all consequential benefits including of salary, revision in pay, and increments.
