Srinagar: Special Judge TADA Court Sunit Gupta on Friday formally framed charges under Sections 364, 368, 120-B of RPC, Section 3/4 of TADA Act 1987 and Section 7/27 of Indian Arms Act against JKLF Chief and others in kidnapping of Rubaiya Sayeed, daughter of former Union Home Minister, Mufti Mohammad Sayeed.
Special Judge TADA Court Sunit Gupta after hearing Special PP Monika Kohli with S K Bhat appearing for CBI and all accused, except Yasin Malik, in person, fixed 3rd March, 2021 for prosecution evidence.
While framing charges, Sunit Gupta Special Judge, designated under TADA Act at Jammu (J&K), observed that Yasin Malik, in first week of December 1989, along with other accused persons mentioned in the charge-sheet, entered into a criminal conspiracy to kidnap Rubaiya Sayeed, who at the that time was undergoing Resident Rotatory Internship Training in Lal Ded Hospital Srinagar and to wrongfully confine her with ulterior motive of getting released five terrorists namely Hamid Sheikh, Altaf Ahmed Bhat, Noor Mohd Kalwal, Javed Ahmed Zarger and Sher Khan of JKLF, who were lodged in different jails, in exchange of her release. In furtherance of afore delineated criminal conspiracy, on December 8, 1989, the accused persons namely Yasin Malik, Mohd Rafiq Dar, Ali Mohd Mir, Iqbal Ahmed Gandroo, Mushtaq Ahmed Lone, Manzoor Ahmed Sofi, Wahajat Bashir, Miraj-ud-din Sheikh, Shoukat Ahmed Bakshi, Javed Ahmed alias Nalka, Nanaji alias Saleem ,Riaz Ahmed Bhat, Khurshid Ahmed Dar, Basharat Rehman, Tariq Ashraf, Shafaqat Ahmed Shangloo and Manzoor Ahmed alias Muna alias Manzoor Islam assembled in house of Mushtaq Ahmed Lone and deliberated upon the plan to kidnap Dr Rubaiya Sayeed, when she would be returning for her house from Lal Ded Hospital Srinagar to Nowgoan Bye pass, Srinagar. The accused kidnapped Dr Rubaiya Sayeed from a mini-bus and kept her in illegal confinement till her release on December 13, 1989 in exchange of aforementioned five terrorists of JKLF.
