Would the Vasco Rape case have to be heard again?

In a surprising development, that is being made to look as legitimate move on part of the government, Judge Anuja Prabhudesai, president, Children’s Court in Goa (who had been holding additional charge of this responsibility for the last two years) is expected to be relived of this responsibility and a full-time new Sessions Judge is to be appointed by tomorrow, this has been revealed on very strict condition of anonymity by a senior government official.

It may be recalled that Judge Anuja Prabhudesai was hearing the case of the seven-year old Vasco rape case, in which the father’s lawyer has brought out startling revelations of the involvement of the nephew of the head-mistress of the Deepvihar School, who has been charged by the Goa Police for negligence but on grounds of destruction of evidence has not been charged.  More importantly, the advocate for the family has asked the Judge in his arguments to look at the crime committed by the Head-Mistress, Class Teacher and Head Clerk in light of the Central Act Section 16 of Protection of Children from Sexual Abuse Act 2012 for abetting the crime and not ensuring a safe environment. Post listening to the arguments yesterday, the Judge is expected to pass on order on March 4th.

Now however, GoaChronicle.com has learnt that there is in all probability that the case will have to be heard again, since yesterday on an urgent basis a file in the government has been moved to appoint a full-time Judge in the same position currently held by Judge Anuja Prabhudesai and that she is expected the relived of her responsibility tomorrow itself.

Interestingly, this Judge Anuja Prabhudesai has been holding the position for the last two years, it is highly questionable that post yesterday hearing on the Vasco rape case, an immediate change is moved to bring in a full-time Judge.
