President approves MHADA Bill

Mumbai: The Maharashtra Housing and Area Development Act Amendment Bill was accorded approval by the President Draupadi Murmu.

This amendment in the bill had paved way for the re- development of dangerous and cess buildings in Mumbai.

The decision is a huge respite for the housing sector of the state and the Mumbaites chief minister Eknath Shinde said on Friday.

According to the new law, the cess buildings whose construction came to a standstill or had been left incomplete can be acquired by MHADA for re- development.

Presently, there are about 56 such buildings in Mumbai city whose re- development is pending or they are left incomplete. Now it will be possible for MHADA to directly take over such cess buildings and re- develop them.

Similarly, if the Mumbai Municipal Corporation had declared any cess building as dangerous, than first of all chance for Re development of such building will be given to the owner or the landlord. If he fails to file a proposal of Re -development within six months, the second chance will be given to the tenant.

If the tenants does not file the proposal of re- development within the next six months and if they do not complete the re- development within the stipulated period, such buildings and the owners of such buildings or that landlords will be given 25 percent of the ready reckoner or 15 percent of the constructed area of saleable part, (which ever will be more) will be given as compensation and such provision has been made in the Act.

The buildings whose construction has been stalled since many years can now be re-developed and approval of president has paved the way for the re- development.

On 28 July, 2022 the state government had sent the information and all documents related to the pending re -development scheme along with all the photographs and information of pending cases.

Deputy chief minister Devendra Fadnavis had been following- up the issue with the union government. Now that the president has accorded approval to the bill, the re- development work of the buildings in Mumbai will gain momentum.
