Lakhimpur Kheri case: SC allows Ashish Mishra to visit & reside in Delhi

New Delhi: The Supreme Court, on Tuesday allowed Ashish Mishra, accused in the Lakhimpur Kheri case, to visit and stay in the NCT of Delhi to look after his ailing mother and to get treatment for his daughter in Delhi.

A bench of the Supreme Court, headed by Justice Surya Kant, passed the order on Tuesday.

Ashish Mishra is the son of union minister and Bharatiya Janata Party (BJP) Member of Parliament (MP), Ajay Kumar Mishra.

The Apex Court, in its order today, also lifted the previous condition that had prohibited him from traveling and entering Delhi-NCR.

The Top Court also made it clear that he should not participate in any public function or address the media in relation to the sub judice case.

The Apex Court, however, said the bar against his entering Uttar Pradesh state will still continue.

Eight people, including four farmers, were killed on October 3, 2021, after violence broke out in Lakhimpur Kheri district of Uttar Pradesh during a protest against the Centre’s new farm laws that have now been repealed. Farmer bodies have alleged that a vehicle belonging to Mishra ran over a group of demonstrators.

The accused, Mishra, was first arrested in the case on October 9, 2021. He walked out of jail on February 15, 2022, after the Allahabad High Court granted him bail.

On December 6, an Uttar Pradesh court framed charges against 14 people, including Mishra.

Mishra has been charged with a number of offences, including murder, attempt to murder, rioting, and criminal conspiracy.

The trial will begin on December 16.
