Centre files plea in SC, has written to all states for their views on legal recognition of same sex marriage

New Delhi: The Centre on Wednesday filed a fresh application in the Supreme Court saying that it has started consultation process with states on the issue as states are vital stake holders in it.

The Centre, in its application, also requested the Top Court to make states and UTs (Union Territories) party to the present proceedings.

The Centre, also said that, if the Apex Court doesn’t do this, then allow the Centre to finish the consultative process with the States, obtains their views and place it before the court. Till then the proceedings should be adjourned, it requested.

The Union of India has issued the letter yesterday, the day the SC started hearing arguments, to all States “inviting comments and views on the seminal issue raised in the present batch of petition, the Centre said.

The letter of the Centre said, it and states’ right to legislate on the subject will be affected by any decision of the SC on the subject. As states have already legislated on the subject through delegated legislations, they must be impleaded as necessary parties and heard in the case.
