Hope SC uphold the constitution of India while hearing Article 370: Mehbooba

Srinagar: A day after the Supreme Court announced to hear the petitions on Article 370 on a daily basis, Peoples Democratic Party President Mehbooba Mufti hoped that the Apex Court will decide the case in accordance with the Constitution and law of the country.

Addressing a press conference in Srinagar on Wednesday Mufti said the people of Jammu and Kashmir want the SC to do justice with the Constitution of the country and not to satisfy the collective sentiment of the people of India.

She hoped that the Chief Justice of India who had unquestionable integrity would appreciate the sentiment of the people of J&K and would give a decision in favour of the constitution and law.

The PDP chief raised concern over the listing of the Article 370 petitions immediately after Chief Justice of India (CJI) Justice D Y Chandrachud and Supreme Court judges visited Kashmir for the ’19th All India Legal Services Authorities’ meeting last month.

Mehbooba said that the 200 judges who were brought here during a seminar recently were just to show them that everything is all right in Jammu and Kashmir.

“There are apprehensions that after four years the Supreme Court has decided to start hearing on Article 370 from August 2 on a daily basis suddenly….. the BJP has laid a trap to mislead the world by holding G20 meeting here and bringing Judges from all across the country just to show them the silence of graves in Jammu and Kashmir…. It seems that something happened behind the curtain,” she alleged.

“However, I hope that all these judges, who are wise and decide the destiny of the people, must have seen what the reality is behind the wall.”

She said the Government of India submitted a fresh affidavit in which they tried to justify the scrapping of Article 370 but the Supreme Court has said that it would not consider it.

Mufti said BJP has torn apart the constitution and law of the country.

She said if they (BJP) said that stone pelting has been stopped after Article 370 was scrapped, why thousands of youth and religious leaders would have been put in jails.

She said that raids are being conducted on a daily basis and monitoring is also taking place.

“You (BJP) governments have adopted Israeli policy in Jammu and Kashmir. The BJP is claiming that the situation in Jammu and Kashmir has improved with the abrogation of Article 370…It is like that when a goon enters a house and beats the inmates and threatens them and later claims that there is everything right as there is no noise or violence in the home… the same thing they (BJP) have done with Jammu and Kashmir,” she said

In a question she said that the Article 370 was never temporary as Supreme Court has in its previous judgments in the case of Sampat Prakash, Prem Nath Koul, Vijay Lakshmi Jha said that unless the constituent assembly of Jammu and Kashmir would recommend to the President of India for scrapping the Article 370, there is no question of its being temporary.

Mufti said that “Article 370 automatically becomes special …and it cannot be, it will not be, it should not be removed… are not my words, these are the words of Supreme Court in a verdict that only with the recommendation of the constituent Assembly of Jammu and Kashmir to President for its abrogation”.
