Patna HC strikes down Bihar govt’s move to hike quota to 65 pc

Patna: Patna High Court on Thursday scrapped reservation hike in government services to 65 per cent, saying it was against the earlier verdict of the Supreme Court.

A Division Bench of the high court headed by Chief Justice K Vinod Chandran passed the order observing that that the decision of Bihar Government to increase quota to 65 percent in government services was not in accordance with the law.

The bench pointed out that the Supreme Court in a case related to Indira Swahney vs Union of India, had fixed the upper limit of quota in government services up to 50 percent.

The Bihar Government in November last year had increased the quota of SC, ST, EBC and OBC to 65 percent in the state government services.

Apart from this, 10 percent reservation was allowed to exist in government services for poor among upper caste as earlier.
