Farm house case: HC refuses to stay on single bench Judge order to hand over case to CBI

Hyderabad: The Telangana government has suffered another setback in the farm house case as the Division Bench of the High Court upheld the judgment given by the single bench judge transferring the investigation of MLAs purchase case to CBI.

The court rejected the appeals filed by the government and BRS MLA Rohit Reddy asking that the case not be handed over to the CBI.

A bench comprising Chief Justice Ujjal Bhuyan and Justice N Thukaramji opined that the judgment of the single judge cannot be faulted and there is no need to interfere in it.

Advocate General (AG) urged the bench that the state government is planning to go to the Supreme Court against the High Court verdict, and therefore the verdict should not be implemented for 15 days. However, the High Court rejected the AG’s request.

On October 26, 2022, Acchampet MLA Guvvala Balaraju, Kollapur MLA Beeram Harshavardhan Reddy, Pinapaka MLA Rega Kantha Rao and Tandoor MLA Pilot Rohit Reddy filed a complaint with the Moinabad police, alleging that they were tempted in the Moinabad farmhouse.

Based on their complaint, the police registered a case and arrested Ramachandra Bharati, Simhayaji and Nandakumar. The state government has set up a SIT to investigate the farm house case. However, the accused have filed a petition in the High Court claiming that the SIT investigation is not being done transparently, and hence the case should be handed over to the CBI.

The single judge bench in its order on December 26,2022 quashed SIT and handed over the case to the CBI.

The state government challenged the order of the single judge in a division bench of the High Court on January 4 this year. After hearing the arguments of both sides, the high court today upheld the order of the single judge bench and asked the state government to submit written arguments till January 30.
