SC allows plea of DMK MP Kanimozhi & quashes proceedings on an election petition filed against her

New Delhi: Relief for DMK Member of Parliament (MP) Kanimozhi, with the Supreme Court in its verdict on Thursday dismissed a petition filed by a voter Santhana Kumar against her election as MP from Thoothukudi in 2019.

Kumar contended before the Supreme Court that she failed to mention her husband’s Permanent Account Number (PAN) in her election affidavit disclosing family assets, and thereby the Apex Court should pass appropriate directions against her.

A two-judge Bench of the Supreme Court, headed by Justice Ajay Rastogi and also comprising Justice Bela Trivedi allowed the appeal filed by the DMK leader challenging the Madras High Court’s refusal to dismiss the election petition disputing her election from Thoothukudi Lok Sabha constituency in the 2019 general elections.

“Election petition is dismissed, appeal is allowed”, Justice Trivedi said, while reading out from the judgement copy.

The petition was filed by Kumar before the Top Court challenging her election on the ground that she did not reveal PAN number of her husband while filing nomination.

Kanimozhi had moved the Supreme Court challenging the Masras HC decision which agrees to hear the petition against her.

She told the Apex Court that her husband being a Singapore citizen and does not have PAN.

Kumar alleged that she allegedly concealed the PAN card details of her husband.
