SC refuses to stay ED & CBI probe against Abhishek Banerjee in school for jobs scam case in Bengal

New Delhi: Supreme Court in its order on Friday refused to stay Calcutta High Court’s direction, by a new Judge after earlier Judge was changed, to CBI and ED to probe TMC leader Abhishek Banerjee, an accused in the teacher recruitment scam in West Bengal.

The Apex Court two-judge bench, headed by Justice J K Maheshwari and also comprising Justice P S Narasimha, however, in its order stayed the Calcutta HC’s order imposing Rs 25 lakh cost on Banerjee.

The Apex Court cited that after all these are not issues affecting common citizens, and fixed the matter for further hearing to July 10, after the summer vacation.

Senior Advocate Kapil Sibal, for Banerjee, said these are staged and managed matters. These scams are being generated.

“We will hear the case further on July 10, 2023,” Justice Narasimha said.

Abhishek Banerjee on Monday May 22 moved the Supreme Court against Calcutta High Court allowing CBI, ED probe in school jobs for cash scam.

Banerjee also had challenged Calcutta High Court’s order of imposing costs of Rs 25 lakh on him.

Justice Abhijit Gangopadhyay of Calcutta High Court on April 13 ordered a CBI and ED probe against Banerjee in the school jobs for cash scam and also imposed a cost of Rs 25 lakh on him.

Banerjee’s application, in Calcutta HC, sought to recall the order passed by Justice Gangopadhyay were also rejected later by Justice Amrita Sinha on May 18 and the judge also imposed costs of Rs 25 lakh on him.

In her order, Justice Sinha also pulled up the CBI and the ED for its slow pace in the investigations.
